OPENING THE SOFTWARE ASSUMES THAT YOU HAVE READ AND THAT YOU AGREED TO THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT OPEN AND INSTALL THE SOFTWARE.

1. USE

You (an entity or a person) may use MusicGoals Eye & Ear (the Software) if you meet the following conditions. In addition, you may make one (1) archival copy of the Software.

MusicGoals Eye and Ear is commercial software. It is not freeware or shareware. It is subject to international copyright laws. With purchase and registration the license holder has the right to install and use MusicGoals on one computer at one site. The license does not constitute ownership of the software. The license grants a specific right to use the software only.

Single license: You must acquire one copy of the Software for each computer on which the Software will be installed. You may not use a single license on more than one computer at a time. The primary user of the computer may use the Software on a home and laptop computer, provided the Software is used on only one computer at a time.

Site license: A site license may be obtained for an additional charge. A site license allows for the installation and simultaneous use on multiple computers at one location.
2. RESTRICTIONS

You may not alter, merge, modify or adapt the Software in any way including reverse engineering, disassembling or decompiling. You may not sell, distribute, loan, rent, lease, license or otherwise transfer the Software or any copy.

3. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in the Software and user documentation are owned by Singing Electron LLC or its suppliers and are protected by applicable intellectual property laws (including patent, trademark and copyright laws) and international treaty provisions. Singing Electron LLC retains all rights not expressly granted.

4. LIMITED WARRANTY

SINGING ELECTRON LLC MAKES NO WARRANTY, REPRESENTATION, PROMISE OR GUARANTEE, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE SOFTWARE, USER DOCUMENTATION OR RELATED TECHNICAL SUPPORT, INCLUDING THEIR QUALITY, PERFORMANCE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Should the product media be defective, replacement will be made for a 90 day period after original shipment upon return of the original media with proof of purchase.

5. LIMITATION OF LIABILITY

IN NO EVENT WILL SINGING ELECTRON LLC BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, TORT, ECONOMIC, COVER OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THIS PRODUCT OR SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES OR COSTS RELATING TO THE LOSS OF PROFITS, BUSINESS, GOODWILL, DATA OR COMPUTER PROGRAMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE SHALL SINGING ELECTRON LLC LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE OUT OF WHICH SUCH CLAIM AROSE.
